(hereinafter referred to as the “Employee”) of the second party
甲方僱用乙方於中華民國境內擔任 工作而簽訂本合約。雙方約定事項有關條件詳列於下:
Whereas, the Employer is desirous of employing the Employee to work as a for the Employer in Taiwan, R.O.C.; Now therefore the two parties mutually agree to enter into this Employment Contract as follows.
第一條 :契約期間
Article 1:Term of Contract
自乙方抵達中華民國台灣地區報到之日起年月日(可展延),並以最初之四十日為試用期間。期滿甲方徵求乙方同意後,並依中華民國政府法令規定,得重新商定勞動契約延期一年者外,期滿勞僱關係自動終止。
This Contract shall be valid for a period ofyear(s)month(s)day(s) (Renewable), commencing from the date when Employee arrives in Taiwan and reports to duty, and the first forty (40) days therefrom shall be the probation period. Unless otherwise agreed by Employee and approved in accordance with the Laws and regulations of the R.O.C. to have the Employment Contract renewed for a further period of one (1) year, this contract shall be automatically terminated upon expiration hereof.

第二條 : 工作義務
Article 2:Obligations
乙方接受甲方監督指揮,擔任甲方所指定之工作,並應保持良好態度,妥善維護本人及同事之安全。
Under the supervision and direction of Employer, Employee shall take a good attitude to do the job as designated by Employer and properly keep himself/herself and other associates safe to maintain good manners.

第三條:工作時間
Article 3: Work Time
每日正常工作時間八小時,每週工作六日。如有超工作或晝夜輪班需要時,乙方應配合甲方要求依中華民國勞動基準法令辦理。
Employee shall work eight (8) hours per day, six (6) days per week normally. In the event that over-time working or day/night shift is required, Employer should comply with. This over-time working or day/night shift should be subject to the regulation of the labor Laws of R.O.C.

第四條:工作報酬
Article 4: Remuneration
4.1工資:月支工資為新台幣元,4.2每月定期發給並依中華民國有關法令規定由甲方代表為扣繳工資所得稅及勞健保費用自繳部分。
Salary:Monthly salary is NT$ , payable on a fixed date each month, from which Employer may withhold the income tax and deduct the portion of health labor insurance premium to be borne by Employee in accordance with the Laws and Regulations of the R.O.C.
4.2超時工作報酬計算方式,依中華民國勞動基準法。
Overtime payment shall be computed in accordance with the Labor Standards Law of R.O.C.
4.3 甲方提供乙方膳宿,但每月自薪資中扣新台幣 元膳宿費。
Employer provide the employee food and accommodation and deduct NTD from salary per month.
4.4 乙方自付前往中華民國及服務期滿後返國之機票費用。
Employee shall pay with economy class air ticket from Indonesia to R.O.C. and after Employee has completed Employment with Employee back to Indonesia.

第五條:休假及病假
Article 5: Leave or sick Leave
5.1 乙方於服務每滿一年由甲方給予特別休假七日,或折發工資。
In case Employee has worked for a full year, employer shall grant Employee a special vacation for seven (7) days which may be converted into cash.
5.2 乙方因普通傷病需請假者依中華民國勞動基準法之勞工請假規則規定辦理。
Employee shall have sick leave in case of sickness or injury in accordance with the Regulation of the Labor Standards Law of the R.O.C.
5.3 乙方每七日中享有一天休假,每年並享有11項之國定假日如下:
Employee shall have one day off in every seven days, and have following 11 national holidays every year:
開國紀念日(1月1日)
 Peringatan berdirinya R.O.C.
和平紀念日(2月28日)
 Hari Perdamaian
3. 清明節(4月4日)
Hari Ching Beng (sembahyang kuburan)
4. 勞動節(5月1日)
 Hari Buruh
5. 端午節(農曆5月5日)
Hari Tuan Wu (Bacang)
6. 中秋節(農曆8月15日)
 Hari Cung Chiu (kue bulan)

7. 國慶日(10月10日)
 Hari Nasional R.O.C.
8. 國父誕辰(11月12日)
 Hari kelahiran Dr. Sun Yat Sen
9. 行憲紀念日(12月25日)

第六條:勞工保險
Article 6: Labor Insurance
於聘僱期間內,甲方應為乙方辦理加入勞工及健康保險,保險費之負擔則依中華民國勞動基準法及相關法令分攤之。
During the period of employment, Employee shall join the labor insurance, for which the payment of insurance premium and the claim of insurance benefits shall be made in accordance with the provisions specified in the Labor Insurance Act of the R.O.C.

第七條:契約之終止及效果
Article 7: Termination and Its Effect
7.1 乙方在試用期間內,如無法適任工作時,甲方得終止契約將其遣送返國,乙方應無異議立即返國,並負擔來回機票費用,該項費用若由甲方或其他人先行墊付者,乙方應負責償還。
During the period of probation, if Employee is found to be incompetent, then Employer may terminate this contract and have him/her repatriated, to which Employee shall make no objection and shall bear the airfares to and from Taiwan. In case such airfares are paid in advance by Employer or any third party, Employee shall be liable for the repayment thereof.
7.2 乙方在契約期間內,如有下列情形之一者,甲方得終止契約,乙方應無異議立即返國,並負擔來回機票費用,該項費用若由甲方或其他人先行墊付者,乙方應負責償還。
If Employee is in any of the following circumstances during the term hereof, Employer may terminate this contract, for which employee shall forthwith return to his/her home country without any objection and shall bear the airfares to and from Taiwan. In case such airfares are paid in advance by Employer or any third party, Employee shall be liable for the repayment thereof;
(1) 勞工對於所擔任之工作確實不能勝任,並經書面警告三次以上者。
To be unable or unqualified for the work specified by Employer, and already been warn in a legal paper for 3 times or more.
(2) 受聘僱期間,拒絕接受定期健康檢查或其身心狀況無法勝任所指派之工作或罹患法定傳染病或死亡者,或經發現為嗎啡或安非他命藥物非法使用者。
To refuse to take the scheduled semi-annual medical examination, or be unsuitable for the work assigned in according to his/her physical or mental status, suffer from any notifiable diseases or death; or to be found that illegally use of Morphine/Amphetament.
(3) 違反中華民國法令,情節重大者。
To seriously offend the Laws and Regulations in the R.O.C.;
(4) 自行從事許可以外之工作。
To engage in the works not approved by government of R.O.C.;
(5) 自行受聘僱於為其申請許可以外之雇主者。
To engaga in employment other than with Employer who applied, and has been approved by the government R.O.C
(6) 喪失工作能力者,但職業災害所引起者除外。
To lose his/her work ability except the one caused at work;
(7) 無正常理由連續曠職三日或一個月內曠職達六日者。
To be absent for consecutive three days without justifiable grounds or be absent for six days in a month.

第八條:適用文字
Article 8: Controlling Language
本契約為中英印對照,中文本與英文本或印文本間若有任何差異,應以中文為準。
This contract is made both in Chinese and English languages. In case there is any difference or discrepancy between the Chinese version of this contract shall be controlling.
第九條:準據法
Article 9: Governing Law
本契約之解釋與履行應以中華民國法律為準據法。
This contract shall be construed in accordance with and governed by the laws of the R.O.C.

第十條:其他約定事項
Article 10: Others
10.1 乙方應遵守甲方之工作規則及有關規定。
Employee shall act in compliance with the work rules specified by Employer or other related regulations.
10.2 雙方均應遵守勞動基準法及勞工安全衛生有關規定。
Both parties hereto shall comply with the provisions set forth in the Law Governing Safety and Ssnitation of Works in the R.O.C.

本契約正本一式二份須經我國駐外機關驗證,雙方各執一份,副本三份除一份報中華民國主管機關備查外,另一份由印尼仲介公司公司存查,另一份由台灣仲介公司存查。
This Contract is made in two originals and two copies. Two originals shall be certified by the representative office of the R.O.C. in Indonesia and held each by a party hereto, while one copy will be submitted to the competent authority of the R.O.C. for filing purpose, and the other copy be kept by Taiwan & Indonesia Agency for reference.


